Utah driver accused of driving under the influence of alcohol

Recently, a man leaving a restaurant in a Utah township supposedly lost control of his vehicle, which sent it barreling through the front of another eating establishment in the same business complex. Police were called to the location at approximately 3:43 a.m. When they arrived, they suspected the man behind the wheel of the pickup truck with driving under the influence of alcohol.

The man allegedly driving the truck at the time of the accident was behind the wheel when police arrived. Reportedly, he did not suffer any injuries in the crash. Police took the man into custody at the scene.

Later that morning, the extent of the damage to the restaurant's front was described by the owner of a piercing and tattoo shop. He says that he arrived to find the area in shambles. There was still glass everywhere, and a support beam in the front of the restaurant that was hit was destroyed.

Utah prosecutors will be responsible for proving that this was anything more than just an unfortunate accident. In order to do that, it will first need to be proved that he was impaired at the time of the crash. This will entail proving to the court beyond a reasonable doubt that the officer or officers at the scene did not somehow violate the driver's rights and performed any field sobriety tests accurately in accordance with current policies and procedures. The same may be said for any breath or blood tests conducted in this case.

Just because someone is charged with driving under the influence of alcohol, that does not automatically mean he or she is guilty. The driver and his criminal defense team will have the opportunity to refute the charges. After a careful review of the circumstances and the evidence that prosecutors intend to present at trial, a suitable defense can be discussed along with any other available options.
