Staying off the emotional roller coaster of divorce is crucial

The fact is that marriages do not end because the parties are working together and getting along. Therefore, it is probably safe to say that the Utah divorce process is not always going to go smoothly. What can help, however, is staying off the emotional roller coaster.

More than likely, each party knows exactly which buttons to push to irritate the other. It would be easy to engage in a game of emotional tit-for-tat, but that is not going to serve either party in the end. As often as possible, the parties would benefit more from agreeing to a truce in order to negotiate a settlement.

Otherwise, they could end up in a lengthy and costly court battle that will leave both parties emotionally and financially broken. Instead, it might be beneficial to explore the possibility of working toward a settlement without court intervention. This allows the parties to retain control over how the agreement is structured.

Furthermore, the provisions of the agreement can be tailored to fit what the family needs. If a Utah judge was making the decisions, he or she would, for the most part, be bound by statutory guidelines. Therefore, it would be preferable in most cases for the parties to be able to work together for a settlement with which both parties are satisfied.

No one would expect someone going through a divorce to feel nothing. However, those feelings are best dealt with outside of the proceedings. As an added bonus, a couple can employ various professionals to work with them and their attorneys in order to ensure that the settlement is as fair and equitable as possible.

  • Brian attended mediation with us today and he was a rockstar. He was very knowledgeable and thorough. I don't know what we would have done without his well-informed counsel and the way he stood up for us. He maintained a calm and authoritative demeanor, even in the presence of the 4 other attorneys on the other "sides". We will be recommending him to anyone who needs a family law attorney, and we'll be choosing him if we ever need one again! Read more...
