Divorce often means considering child custody

Most parents want what is best for their kids, and they often take their kids into consideration when making major life decisions. Still, even if parents know that their choice will have significant effects on their children, they may need to move forward nonetheless. This is often the case with parents who choose to divorce.

Though ending a marriage will disrupt their children's lives, many Utah parents feel that they will be able to parent better if not in an unhappy marriage. Of course, that means that child custody proceedings will be necessary for parents with minor children, and those proceedings can be difficult at times, especially if the parents are not on the same page. If they cannot come to an arrangement themselves, the court will have the final say.

Whether the court opts for joint custody or sole custody will depend on a number of factors associated with the children's best interests. For example, the court will undoubtedly not award sole custody to a parent with a blatant history of physical abuse. Still, major red flags like abuse are not the only details the court considers as the health of each parent, lifestyle, special needs of the children, the emotional attachment of the children to each parent and much more will have an effect on what the court decides.

If the decision does land in the hands of the court, Utah parents may still have the opportunity to argue why a certain custody arrangement would be best. As a result, individuals going through divorce and facing this predicament will certainly want to prepare as best as possible.
