In Utah, when a couple files for divorce, the court will presume that the couple had some form of irreconcilable differences leading to the divorce if no other reason is given. If any party alleges some sort of fault on the other party, he or she must then prove that in court. While a cheating spouse basis may be established in court, it is not necessary for one spouse to allege infidelity as the grounds for divorce in order to affect the outcome.

According to Utah code 30-3-5(8)(c), adultery may be a factor that is considered when determining alimony. For example, if the infidelity significantly depleted marital funds, then a court may look at the effect it had when determining alimony.
