Utah man under investigation for alleged DUI on an ATV

Anyone accused of drunk driving faces potentially serious consequences. However, when the DUI involves innocent children, it may make having a solid criminal defense against the charges that much more critical. The Utah County Sheriff's Office is currently investigating a man whom they say was drunk when he crashed his ATV with a 4-year-old boy and a 10-year-old girl aboard. All three were injured in the accident.

The crash occurred on a recent Sunday afternoon at Utah Lake. Witnesses told deputies that the accused was using excessive speed and driving erratically when the ATV hit a bump. The rear of the ATV lifted up and the vehicle fishtailed, causing him to lose control. He then crashed into a parked car.

The accused told police that the accident was caused by the throttle getting stuck. He admitted that he had been drinking and submitted to a blood test. Neither child was wearing a helmet at the time of the crash. The boy only sustained minor abrasions. The girl, who is the man's daughter, had head and back injuries, including a possible skull fracture.

If the blood test shows that the man's blood alcohol level was above the legal limit, he will face a charge of DUI. It's likely he will also be cited for two helmet violations. These offenses may be enhanced because of the children's injuries. He may benefit from working with his legal team to uncover the best defense strategy so he can fight these charges in a Utah courtroom.
