Mediation can save time, money and headache in a divorce

Utah couples have the option not to take their issues to court when they divorce. If a couple ends up in divorce court, they could spend copious amounts of time and money fighting a losing battle. Mediation can provide an alternative to that fate. 

One of the main reasons that couples end up in court is because their emotions are overruling their better judgment. When emotion is taken out of the equation, the parties might be in a better position to negotiate their own settlement. Fortunately, they do not have to do it alone. A mediator and each party’s attorney can help.

Mediators are not bound by the same restrictions as judges. Every family is different, but the courts are still required to apply a one-size-fits-all approach unless the circumstances are well outside the norm. Mediators are free to pursue unique avenues when it comes to resolving the parties’ issues. The settlement can be tailored to the needs of the individuals.

The parties are encouraged to work together, which gives them ownership in their settlement. Sources estimate that the cost of mediation can be as much as 60 percent less than traditional litigation. This fact alone could persuade some Utah couples to at least try mediation. Any issues that remain unresolved could be taken before the court.

Getting a divorce is never easy. However, mediation could make the process less contentious and save the parties the headache of going to court. In addition, couples are often able to walk away from a mediated settlement feeling as though they were treated fairly and equitably.
